CHICKEN TREAT ONLINE ORDERING TERMS AND CONDITIONS

The Chicken Treat Online Ordering facility (“the Service”) is provided by Australian Fast Foods Pty Ltd ACN 008 647 907 (referred to as “Chicken Treat”, “us” or “we”).

These terms and conditions apply to the use of the Service when it is used as an online ordering facility.

By placing an order using the Service you confirm that you have read and understood these terms and conditions and agree to be bound by them (as may be changed from time to time) and you consent to Chicken Treat’s collection, use and disclosure of your personal information in accordance with Chicken Treat’s privacy policy (refer to https://www.chickentreat.com.au/privacy/ ) as may be amended from time to time and incorporated here by reference.

USE OF THE SERVICE

The Service is only available to individuals aged 18 years or over who are resident and accessing the Service in Australia via the Chicken Treat website and associated applications.

Those persons under the age of 18 are eligible to order provided they are over the age of 13 and receive parental or guardian consent. Parents/guardians may be required by Chicken Treat to enter into a further agreement as evidence of consent for a minor to order online.

Chicken Treat may, in its absolute discretion, refuse to provide the Service to any person for any reason and Chicken Treat will not be liable for any costs, loss or damage incurred by you if we refuse to provide the Service to you.

PLACING AN ORDER

To place an online order using the Service, you must follow the prompts on the ordering pages of the Service. You are able to correct errors on your order up to the point on which you click the “Checkout” button on the “Your Order” page.

You must provide the requested information for us to process your order. We reserve the right to request further information from you at any time to enable us to complete your order and/or to comply with regulatory requirements.

We will use various procedures to authenticate each transaction. In the event we consider that we cannot authenticate a transaction then we may, in our absolute discretion, cancel it.

By placing an order you confirm that all information contained in the order is correct.

ORDER CONFIRMATION

After you click on the required payment option on the “Check your delivery details”, you place your order with us and we receive your order, the system will send an automated email to the email address you have provided, setting out the details of your order.

You cannot change any order you place with us.

Any order placed using the Service is an irrevocable offer by you to purchase the particular items referred to in the order for the price stipulated.

We may, at our sole discretion, accept or reject an order we have received.

Each order placed for items using the Service that we accept results in a separate binding agreement between you and the owner of the Chicken Treat restaurant supplying those items.

FEES AND CHARGES

We will charge you and you agree to pay the following fees and charges in relation to any order made using the Services:

The purchase price for each item comprising the order; and

Any other fees and charges set out in the terms and conditions including delivery fees.

We reserve the right to alter the agreed price for any items contained in an order if an incorrect price was cause by a software fault, error or malicious attack.

A surcharge may be payable on Public Holidays and will be included in the product pricing.

PAYMENT VIA DEBIT/CREDIT CARD

For orders paid by credit card or debit card, your card will be debited with the relevant amount once you press “Pay Securely” on the “Card Details” page. To protect you against fraud, we may require that the card used to pay for an order to be presented at the time of collection of your order.

The card must belong to the person placing and receiving the order. You must ensure that the card is registered in your name and your account has sufficient funds available to cover your order and any applicable fees.

We accept the following credit cards only:

VISA; and

Mastercard.

If we are unable to successfully process your credit card payment for your order that is accepted by us then we may notify you of dishonour and cancel the order.

You must not pay or attempt to pay for items using the Service through any fraudulent or unlawful means.

CATERING ORDERS

We offer an online catering order service for our products that is subject to these terms and conditions.

Catering orders must be placed with a minimum 48 hours’ notice. We may at our discretion require longer preparation times for large order or availability of product.

The minimum catering order is $60 and the Catering Website will list the applicable minimum and maximum quantities of each item.

If you use a third party delivery service to collect your catering order, we take no responsibility for the proper handling and storage of the food collected by the third party delivery service (including allergen cross-contamination during the delivery process). By using a third party delivery service, you acknowledge and agree that the products you consume are your responsibility and (to the extent permitted by law) you release us from any liability whatsoever, whether in contract, tort (including negligence) or otherwise, for any illness suffered or any loss or damage incurred as a result of your use of a third party delivery service and/or consumption of our products delivered to you by a third party delivery service.

MINIMUM AND MAXIMUM ORDERS

The Service is only available where:

• The minimum order is A$22.00 for delivery orders;

• The minimum order is A$65.00 for catering orders;

• The maximum order (paid for by credit card) is A$300.00 for click and collect and delivery orders.

• The maximum order is A$2,000 for catering orders.

REFUNDS & CANCELLATION POLICY

You may request to cancel or change your Order after it has been submitted and payment has been authorised through the Online Ordering Platform for non-catering pick-up orders only, and only whereby the order has not been sent for preparation to the store by you. Requests for cancellations may be made by contacting the store by telephone or contacting Chicken Treat through the Chicken Treat website.

No refund will be permitted if you attempt to cancel or change your Order after submitting the order for preparation.

If we are unable to fulfil your Order, or if a product is no longer available, we will contact you either before you collect the Order at your chosen Chicken Treat restaurant or before your Order is collected from the Chicken Treat restaurant fulfilling your delivery. We will seek to replace the unavailable item with another item of similar or equal value or refund the amount that you have paid for that unavailable item.

If an order via delivery is cancelled by the delivery provider, or cancelled by the Chicken Treat online ordering system for any reason, refunds will automatically be applied within 7 business days.

For manually processed and approved refunds, these will be credited within 7 business days.

PERSONAL INFORMATION AND SECURITY

We use secure service software to make our internet transaction secure. You should review our privacy policy to find out how we may use and disclose your personal information. You agree that all information provided by you is true and correct that any material information not be withheld and you will provide us with any additional information that may be required by us.

All credit and debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment, your order will not be accepted.

RISK AND TITLE

Risk in the items ordered using the Service passes to you on the date and time of receipt of the order and title of these items passes to you on the latter of:

Payment of those items;

Receipt of those items.

LIMITATION OF LIABILITY

We use reasonable care and skill in providing the Service and are (to the extent provided by law) not liable for any of the following:

If we do not perform any of our obligations to you due to failure of any technical systems or for any other reasons beyond our control;

For any damage to your computer or mobile phone or other facilities as a result of using the Service; or

Any indirect, or consequential losses, claims or damages (including without limitation loss of profit, loss of production, loss of contracts, loss of opportunity) suffered by you or incurred from your use of this Service however caused.

Our maximum liability (to the extent provided by law) to you in respect of each use of the Service shall be the refund of the purchase price of your order.

INDEMNITY

You must indemnify us from and against all claims, liabilities, damage, suits and losses made against or suffered by us as a direct result of:

Your fraudulent or wilful negligent act or omissions;

Any breach of these terms and conditions by you;

Your act or omissions which causes us to be in breach or any law or regulation; or

Personal injury, death or property damage caused or contributed to by you.

GENERAL RESTRICTIONS

You must not:

use the Services for any activities that breach any laws, infringe a third party’s rights or are contrary to any relevant standards or codes;

use the Services in a manner or way which interferes with other users or our other customers or defames, harasses, threatens, menaces or offends any person or which prevents any other person from using or enjoying the Services;

make fraudulent or speculative enquiries, purchases or requests using the Services;

use another person’s details without their permission or impersonate another person when using the Services;

tamper with or hinder the operation of the Services;

knowingly transmit any viruses, worms, defects, trojan horses or similar disabling or malicious code to our website or associated application associated with our Services;

reformat or frame any portion of the web pages that are part of our website or associated application associated with our Services;

use our website or associated application associated with our Services to violate the security of any computer or other network or engage in illegal conduct; or

use the Services other than in accordance with these terms and conditions.

WARRANTIES

You warrant that:

all information and data provided by you to us using the Services is true, accurate, complete and up to date; and

the person receiving any items ordered on your behalf is authorised by you to do so.

INTELLECTUAL PROPERTY RIGHTS

You:

acknowledge that the copyright in the website, associated application, the software, design, text and graphics associated with the Services and its content and materials (together, the “Materials”) are owned by or licensed to us;

must not modify, copy, adapt, store in a retrieval system, reproduce, upload, post, transmit, sell, distribute in any way or communicate to the public a Material without our prior written consent; and

must not frame or embed in another website any of the Material without our prior written consent.

The Materials contain registered trade marks and other trade marks which are protected by law. You must not use any of these marks or trade marks or our name or the names without our prior written consent.

ALTERATION OF TERMS

We may, at any time, with immediate effect, change or withdraw the Service or these terms and conditions without liability to you. If we revise these terms and conditions, we will post a revised version. By using the Service after we have changed these terms you will be accepting the changes.

THIRD PARTY RIGHTS

When you place an order via the Service and we receive the payment for the order and accept your offer to enter into the contract for the related Service, we are entering the contract with you personally (save and except to the extent that the Chicken Treat restaurant delivering your order is owned by a franchisee, in which case the contract in respect of the supply of the order is between you personally and that franchisee). Nothing in these terms will confer any benefit on any third party or any right to enforce these terms on any third party.

LAW AND JURISDICTION

Our relationship should be governed and interpreted according to the laws of the State of Western Australia. Any disputes which cannot be resolved between us shall be resolved in the courts of Western Australia.

COMPLAINTS AND COMPLIANCE

AGENCY

Where an order is prepared, processed and received from a Chicken Treat store that is franchised by us:

We merely act as an agent of that franchisee;

We in the capacity as agent, collect and process any online payments and remit them to the relevant franchisee;

We do not in those circumstances provide you with any goods or services; and

We make no warranties or representations regarding the goods and services to be provided (including availability and collection).

**CHICKEN TREAT FLOCK REWARDS LOYALTY PROGRAM**

**TERMS AND CONDITIONS**

1. This document contains the Terms and Conditions of the Flock Rewards Loyalty Program ("**Program"**). By downloading the Chicken Treat Appand signing up to the Program, all Participants (defined below) agree to be bound by these Terms and Conditions, as well as any other terms, conditions, policies, notices or disclaimers including information published on the Chicken Treat App or the Chicken Treat website: <https://www.chickentreat.com.au> ("**Website**"), as amended from time to time (collectively, the **"Terms and Conditions"**).

2. The Program is a digital-based customer stamp card program conducted only via the Chicken Treat App and Website. The Program, Chicken Treat App and Website are owned and operated by Chicken Treat (Australia) Pty Limited (ABN 99 060 121 100) ("**Chicken Treat**", "**we**", "**us**" or "**our**" as the context may require) and where applicable, an approved agent authorised to carry out all or part of the Program on behalf of Chicken Treat. 

3. Chicken Treat reserve the right, in its sole discretion to amend, modify or revise these Terms and Conditions, the Privacy Policy, or any of our other policies to protect its legitimate business interests or as otherwise permitted by law at any time without notification or liability, with any amendment being effective immediately upon reposting, and Participants agree to be bound by such modifications or revisions. Chicken Treat will make its best efforts to notify Participants of any changes, but Chicken Treat recommends that all Participants periodically revisit the Terms and Conditions to ensure they are kept up-to-date with any changes made. Nothing in these Terms and Conditions shall be deemed to confer any third-party rights or benefits.

4. A "**Participating Store**" is any Chicken Treat store operating in Western Australia (excluding any Chicken Treat store located at Perth Airport or any regional pop-up stores or event spaces). A full list of Participating Stores can be viewed on the Chicken Treat Website. Participating Stores in this Program may change from time to time.

**PARTICIPATION**

5. Participation in the Program is open to Australian residents aged 16 years or older.

6. Individuals under 18 years old must have parental/guardian approval to participate in this Program, and further, the parent/guardian of the individual must read and consent to these Terms and Conditions. Parents/guardians may be required by Chicken Treat to enter into a further agreement as evidence of consent to the minor participating in the Program.

7. The directors, management and employees (and their immediate families) of Chicken Treat, its related entities, suppliers and agencies whom are directly associated with the conduct of the Program are ineligible to participate in the Program. Immediate family means any of the following: spouse, ex-spouse, de facto spouse, child or step-child (whether natural or by adoption), parent, step parent, grandparent, step- grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

8. For clarity, any employee of a Participating Store is free to download the Chicken Treat App and will be permitted to receive select employee-exclusive vouchers and discounts as set out in clause 34, however, they are not permitted to participate in the Program or obtain a Stamp Card (defined below).

9. To be eligible to participate in the Program, individuals must undertake the following steps:

(a) Download the Chicken Treat App via the Apple App Store or Google Play Store, or visit the Chicken Treat Website;

(b) Sign up to participate in the Program by inputting all the requested details (including but not limited to their first name, last name, valid and unique email address, valid and unique mobile number and date of birth (optional) and submitting the fully completed sign-up form. Mobile numbers must be fully verified via SMS with a one-time pin to complete registration and activate;

(c) Agree, upon signing up to the Program, to receive regular email, in-app, and SMS communications from Chicken Treat including marketing communications in relation to the Program and Chicken Treat products and other related services, offers and other information that may be of interest, with the ability to unsubscribe from marketing communications, if desired pursuant to clause 55; and

(d) Agree to the Terms and Conditions (including any information published on the Chicken Treat App or Website), which may vary from time to time.

An individual who completes the above-mentioned steps and has successfully signed up to the Program is subsequently referred to as a ("**Participant")**.

10. Each Participant can only have one (1) Membership.

11. Upon signing up to participate in the Program, Participants will receive a virtual stamp card ("**Stamp** **Card**") which will be available to view on their Chicken Treat App and once signed in on the website. Stamp Cards will also be sent to the Participant's email address once unlocked but progress is visible only once logged in on the Chicken Treat App or Website.

12. The virtual Stamp Card consists of ten (10) unstamped sections.

13. To participate in the Program and receive one (1) stamp on the Stamp Card, Participants must, in a single transaction, spend AUD$10.00 or more on any Chicken Treat product via the Chicken Treat App at a Participating Store ("**Qualifying Transaction**"). For clarity, Qualifying Transactions must be completed online via the Chicken Treat App or Website, and any in-store purchases (purchase not completed via the Chicken Treat App or signed into the Website) will not be eligible to receive a stamp on the Stamp Card.

14. Only one (1) stamp on the Stamp Card is permitted per Qualifying Transaction (regardless of the amount spent in that Qualifying Transaction in excess of AUD$10.00).

**MEMBERSHIP AND ACCOUNT**

15. There are two (2) public membership tiers as part of the Program:

(a) The Flock Rewards Membership; and

(b) The VIP Rewards Membership

            (each a "**Membership**").

16. In addition to the above membership tiers, there is also one (1) membership tier restricted to active Chicken Treat staff members.

17. The vouchers, offers and benefits available to Participants as part of the Program are dependent on their Membership Tier status (see clause 26 below).

18. Every Participant will automatically receive a Flock Rewards Membership and will have the opportunity to upgrade to a VIP Rewards Membership if they complete their first Stamp Card.

19. In order to upgrade to a VIP Rewards Membership, Participants must complete one (1) Stamp Card. For clarity, a Stamp Card will be deemed as complete once a Participant has made ten (10) Qualifying Transactions. In order to maintain their VIP Rewards Membership status, Participants must continue to complete ten (10) Qualifying Transactions every twelve (12) months from their VIP Rewards Membership anniversary. Once a Participant has been upgraded to a VIP Rewards Membership, they will receive a new Stamp Card. If a Participant has not completed ten (10) Qualifying Transactions by the time of their VIP Rewards Membership anniversary, they will be downgraded to the Flock Rewards Membership tier, and forfeit their current Stamp Card.

20. Each Participant with a VIP Rewards Membership will be reminded of the status of their VIP Rewards Membership eight (8) weeks before their twelve (12) month anniversary.

21. Stamp Cards do not have an expiry date (subject to clause 22 below).

22. In the event that a Participant does not make a Qualifying Transaction within two (2) years of the date of signing up to participate in the Program, or within two (2) years of their last transaction their Membership will be suspended and subsequently deactivated. Once a Participant's account is suspended, Participants understand that they will lose any existing stamps on their Stamp Card and will be required to reactivate their account in order to continue to participate in the Program. Upon reactivating their account, a Participant will be provided with a new Stamp Card at the entry tier.

23. It is a Participant's responsibility to ensure that any contact details, including their email address or mobile phone number provided, for the purposes of the Program are correct, and Chicken Treat will not be liable for any vouchers, offers or discounts delivered to an incorrect email address provided by the Participant.

24. Participants may cancel their Membership at any time during the Program by visiting their account on the Chicken Treat App or Website and following the requisite steps to cancel. Participants may also cancel by contacting Chicken Treat's support team at <https://www.chickentreat.com.au/contact-us>.  However, if a Participant decides to cancel their Membership, they will lose all stamps on their Stamp Card and any access to any vouchers, offers or discounts available to them via the Chicken Treat App or Website.

25. A Participant's Membership is personal to them and may not be shared, transferred or assigned to another person unless expressly authorised by Chicken Treat. Participants will only be entitled to receive the benefits specific to their Membership tier during the period that their Membership is active. Participants understand that Chicken Treat, in their sole discretion and without prior notice or liability, may discontinue, modify or alter any aspect of the Program, including, but not limited to: (i) restricting the rewards, offerings and benefits that are available in any Membership; (ii) restricting the amount of use and/or access permitted via the Chicken Treat App or Website; and/or (iii) restricting or terminating a Participant's right to use their Membership or any part of a Participant's Membership. Participants agree that any termination or cancellation of their access to or use of their Membership may be affected without prior notice to them. Chicken Treat will always, at all times, act reasonably in enforcing these rights, however, Chicken Treat reserves all rights to do so to protect its legitimate business interests and other clients.

**REWARDS AND BENEFITS**

26. Each Participant will receive the applicable vouchers, offers and benefits specific to their Membership tier as detailed in the table below and on the Chicken Treat App or Website. There will be a range of rewards and benefits which are updated regularly. The current details will be made available on the Chicken Treat App or Website and are subject to change.

- After five (5) Qualifying Transactions (online only with minimum spend AUD$10) have been completed, a Participant will receive one (1) $5.00 off voucher to use on their next purchase with a minimum spend of $10.

- After ten (10) Qualifying Transactions (online only with minimum spend AUD$10) have been completed, the Participant will receive a voucher for a free "Tempta Burger" with a minimum spend of $10

- Birthday voucher: $5.00 off birthday voucher with a minimum spend of $10 (subject to Participants providing their date of birth).

VIP Rewards Membership

- Exclusive offers and additional discounts provided on the Chicken Treat App or Website.

- Participants with a VIP Rewards Membership will receive a new Stamp Card that will have additional reward intervals. The additional rewards, discounts and benefits that will be offered as part of the VIP Rewards Membership and on their Stamp Card will be at the discretion of Chicken Treat.

- Birthday voucher: $5.00 off birthday voucher with a minimum spend of $10 (subject to Participants providing their date of birth).

27. The expiry date of all vouchers will be specified within the notification email at the time the voucher is issued. Unless otherwise specified, all vouchers awarded as part of the Program are valid for thirty (30) days from the date of issue. Where possible, a reminder will be sent notifying Participants to redeem their voucher if it has not been used. If, for any reason, a Participant does not redeem a voucher or reward by the expiry date or within the specified time period, then the voucher or reward will be forfeited. Rewards, or any unused portion of a reward, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified. Any ancillary costs associated with redeeming a voucher or reward are not included. Any unused balance of a voucher or reward will not be awarded as cash.

28. Vouchers and rewards will be emailed to Participants and can also be viewed on their Chicken Treat App and Website.

29. All vouchers and rewards can only be redeemed once by each Participant and must be redeemed for online purchases made via the Chicken Treat App and Website.

30. Any voucher or reward awarded as part of the Program is not valid in conjunction with any other offer.

31. Participants understand that the benefits, offers and rewards available are as per what is outlined on our Chicken Treat App and Website. Participants agree that all benefits, offers and rewards are subject to change at any time, without notification and Participants must check the Chicken Treat App and Website for the most up-to-date benefits. Participants will not be entitled to any benefit, offer or reward that has been removed from the Chicken Treat App or Website.

32. Chicken Treat may, from time to time, provide Participants (or select Participants, depending on their Membership tier) with access to enter promotions. All promotions are subject to any terms and conditions specified on the relevant Chicken Treat website.

33. To the extent permitted by law, Chicken Treat may, without notice, withdraw or substitute any reward for another reward of comparable description, value, specification and/or nature. 

34. Employees of a Participating Store who download the Chicken Treat App are eligible to receive a $5.00 birthday voucher and can use their 20% off daily discount on any Chicken Treat product via the Chicken Treat App or Website, however, they cannot participate in or receive any rewards offered as part of the Program. Chicken Treat may choose to offer additional vouchers to employees at their discretion at any time. 

**GENERAL**

35. Chicken Treat reserves the right, at any time, to verify the validity of any Memberships (including the Participant's identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any Participant who they have reason to believe has breached any of these Terms and Conditions, tampered with the operations of the Program or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Program. Errors and omissions may be accepted at Chicken Treat's discretion. Failure by Chicken Treat to enforce any of its rights at any stage does not constitute a waiver of those rights. Chicken Treat's legal rights to recover damages or other compensation from such an offender are reserved.

36. The Program was first introduced by Chicken Treat on and with effect from the 1 July 2025 and will continue until Chicken Treat notifies Participants of the closure of the Program.

37. Any notice under these Terms and Conditions will be deemed to have been given by Chicken Treat if emailed, posted or SMS'd to the address or telephone number provided by a Participant or if published on the Chicken Treat App or Website. 

38. The Program, or part thereof, does not apply where it, or Chicken Treat's conduct of the Program, would be prohibited or hindered by a relevant law, governmental direction or court order.

39. Chicken Treat's decisions in relation to all matters arising under the Program are final, and no correspondence will be entered into.

40. Chicken Treat will not be held responsible for any tax liability incurred by a Participant in connection with the Program, including in relation to any reward, offer or benefit provided as part of a Participant's Membership.

41. In the event of war, terrorism, state of emergency, government lockdown, pandemic or any other kind of disaster or unforeseeable event beyond Chicken Treat's reasonable control, Chicken Treat reserve the right to cancel, terminate, modify or suspend the Program or suspend, substitute or modify a reward.

42. Any information in connection with the Program has been prepared by Chicken Treat based on information available to it and Chicken Treat has taken, and will take, all reasonable care to ensure that information in connection with the Program is accurate, but, to the maximum extent permitted by law, does not accept liability relating to any errors or omissions.

43. Information provided by Participants to participate in the Program remains the property of Chicken Treat.

44. Participants accept that their Membership and the benefits available are provided on an "as is" and "as available" basis without any warranties of any kind either expressed or implied, and all warranties are waived to the fullest extent permissible pursuant to applicable law.

45. The laws of Western Australia govern these Terms and Conditions and each Participant agrees to submit to the jurisdiction of the courts of Western Australia in any action or legal process concerning the Program.

46. Chicken Treat can exercise its rights under these Terms and Conditions at any time within the limits of the law. If Chicken Treat delays in exercising its rights, it does not mean Chicken Treat gives up those rights.

47. Chicken Treat can transfer or assign its rights and obligations under the Program at any time to any person without notice to the Participants for the purpose of protecting its legitimate business interests.

**LIMITATION OF LIABILITY**

48. Chicken Treat does not warrant that a Participant's Membership will be uninterrupted or error free, that any defects will be corrected or that the content is free from viruses or other harmful components.

49. Nothing in these Terms and Conditions, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the *Competition and Consumer Act 2010* (Cth), as well as any other implied warranties under the *Australian Securities and Investments Commission Act 2001* (Cth) or similar consumer protection laws in the States and Territories of Australia (Non-Excludable Guarantees).  All warranties, representations and implied terms including the Non-Excludable Guarantees), are expressly excluded to the maximum extent permitted by law.

50. Except for any liability that cannot by law be excluded, including as may arise under the Non-Excludable Guarantees, to the maximum extent permitted by law, Chicken Treat (including its affiliates, partners, suppliers, licensors and licensees) is not responsible for and excludes all liability in contract, tort (including negligence) or otherwise, for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any problems or technical malfunction (whether or not under Chicken Treat's control) of any telephone network or lines, computer online systems, servers, computer equipment, software, technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to Participants' or any other person's computer related to or resulting from participation in or downloading any materials in the Program; (b) any theft, unauthorised access or third party interference; (c) a Participant's Membership or any other services provided by Chicken Treats as part of the Program; (d) any message or information that is late, lost, altered, damaged or misdirected due to any reason beyond the reasonable control of Chicken Treat; (e) a Participant's redemption or use of a reward; or (f) any tax liability of a Participant arising from the Program.

51. Chicken Treat will not be liable for any delay or failure caused by circumstances outside its reasonable control (including but not limited to any act of God, war, pandemic or epidemic, industrial dispute, electricity or network or communications failure, governmental or legal restraint).

**INTELLECTUAL PROPERTY**

52. All intellectual property including copyright, trade marks, designs, patents and rights to registration thereof, on the Chicken Treat App or Website and any related materials including the Website, applications, software, tools, trade marks, logos, names, concepts, methodologies, data and other materials (excluding the Content), is solely owned by Chicken Treat. No right, title or interest in such intellectual property passes to any Participant.

53. By accessing their Membership via the Chicken Treat App or Website, Participants agree that they will not republish, reproduce, copy, sell, modify or otherwise exploit (in full or in part) any material within their Membership without our express written consent.

**PRIVACY**

54. Chicken Treat collects personal information ("**PI**") in order to conduct the Program and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers. Participation is conditional on providing this PI. Participants consent to Chicken Treat using their PI for these purposes or any other purposes set out in its Privacy Policy. Chicken Treat will also use and handle PI as set out in its Privacy Policy, which can be viewed at <https://www.chickentreat.com.au/privacy-policy/>. In addition to any use that may be outlined in Chicken Treat's Privacy Policy, Chicken Treat may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how Participants may opt out, access, update or correct their PI, how Participants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with.

55. If a Participant wishes to unsubscribe from marketing communications from Chicken Treat, they can do so by clicking on the 'unsubscribe' button at the bottom of a relevant Chicken Treat marketing communication. For clarity, Participants who have unsubscribed from marketing communications will still receive functional/service communications from Chicken Treat, such as emails containing details relating to the Program, or an announcement that the Terms and Conditions have been updated.

**Complaints and Feedback**

56. If a Participant has any complaints or other concerns about any matter relating to their Membership or with regard to Chicken Treat, the Program, the Website or any rewards, offers or benefits available on the Chicken Treat App or Website in general, Participants may make such a complaint by contacting us at <https://www.chickentreat.com.au/contact-us>.
